ICT Initiates Investigation into AL Over Alleged Crimes Against Humanity

The International Crimes Tribunal (ICT) has officially launched an investigation into allegations of crimes against humanity involving the Awami League as a political organization, Chief Prosecutor Tajul Islam confirmed today.
“An investigation officer has been appointed, and the probe is now formally underway,” he told reporters at the ICT premises in Dhaka.
This marks the first time in history that the ICT has decided to investigate a political party for alleged crimes against humanity.
The chief prosecutor added that the assigned officers will aim to complete the investigation promptly. “Once the investigation report is submitted, the tribunal will take appropriate legal actions concerning the Awami League as a party,” he said.
Tajul explained that the investigation was initiated following the issuance of a complaint registration number based on a previously filed complaint.
When asked whether earlier witness statements would impact the case, he noted, “Witnesses have already referenced the party’s involvement during their testimonies. These statements are now part of the judicial record and will serve as crucial evidence for the investigation.”
Addressing concerns that recent amendments to the International Crimes (Tribunals) Act could affect the credibility of the proceedings, Tajul stated, “There is no risk of that. The trial against the Awami League as a party has not started yet. Legal questions typically arise only when a law is amended mid-trial, but the recent amendment has not been applied retroactively.”
Regarding the scope of penalties, he clarified, “A political party cannot be punished in the same way as an individual. However, the law allows for actions such as banning the party, imposing sanctions, seizing its assets, or issuing directives regarding its leaders and members. All of these are included within the legal framework.”
Tajul also emphasized that if credible allegations are presented against other political parties in the future, those will be investigated as well.
He further noted that if formal charges are filed against any individual, that person will be barred from contesting in parliamentary elections or holding positions such as mayor, chairman, or other government or public offices. “This is a new amendment aimed at ensuring that post-revolutionary governance reforms can proceed effectively in the nation’s interest,” he explained.
The amendment was promulgated yesterday by President Mohammed Shahabuddin through an ordinance revising the International Crimes (Tribunals) Act, 1973.
