A cow market cannot be set up in Aftabnagar

The Appellate Division has upheld the High Court’s order suspending the City Corporation’s decision to set up Pasurhat at Aftabnagar on the occasion of the holy Eid-ul-Azha.

A four-judge appellate bench led by Chief Justice Obaidul Hasan passed the order on Monday.

As a result, a cow market cannot be set up in Aftabnagar before the upcoming Eid-ul-Azha, lawyers said.

Advocate Shah Manjurul Haque and Advocate SM Shamim Hossain were in favor of the writ in the court. Barrister Ajmalul Hossain QC appeared for the tenant of the hut, Nurul Islam.

Later, advocate Shah Manjurul Haque and advocate SM Shamim Hossain said that Aftabnagar is a planned residential city. In view of this, the Appellate Division upheld the order of the High Court.

Earlier, on the occasion of Eid-ul-Azha on May 8, the High Court suspended the lease notification for setting up a cow market in Aftabnagar of the capital. The High Court bench of Justice Naima Haider and Justice Kazi Zeenat Haque gave this order along with the rule.

The court gave this order as Aftabnagar is a residential area. Later Nurul Islam, the lessee of the hut, appealed to the Appellate Division against this order.

Earlier Zahurul Islam City Society president Mohammad Alamgir Hossain Dhali and general secretary SM Kamal filed a writ in the High Court challenging the decision to set up a cow market in Aftabnagar.

On April 4, the Chief Property Officer of Dhaka North and South City Corporation (DSCC) issued a lease notice for setting up a sacrificial animal market on the occasion of Eid-ul-Azha 2024. The notification was challenged and writ.

In the writ, the local government ministry secretary, Dhaka North and South City Corporation and the related parties were made defendants.

As per Section 3 (2) and 1st Schedule of Local Government (City Corporation) Act 2009, Aftabnagar (Eastern Housing) is under Ward No. 37 of Badda Thana, which is included in Dhaka North City Corporation (DNCC).
