Beximco to Operate Independently, No More Receivers

The High Court has ruled that all companies under Beximco Group will be managed independently. The verdict was delivered on Wednesday by a High Court bench comprising Justice Farah Mahbub and Justice Debashish Roy Chowdhury, settling the ruling with nine observations.

 

According to the court’s observations, all Beximco entities will remain under the supervision and monitoring of regulatory bodies, including Bangladesh Bank, as per the law. With this decision, there will no longer be any receivers in Beximco Group’s companies, as confirmed by legal representatives.

 

Barristers Ruhul Quddus Kajol and Muniruzzaman represented Bangladesh Bank in court, while senior lawyer Fida M. Kamal and lawyer Anisul Hasan represented Beximco Pharmaceuticals. Senior lawyer Barrister Masud R. Sobhan argued for the writ petition.

 

Following the verdict, senior lawyer Ruhul Quddus Kajol explained that, after a political shift, the High Court had directed Bangladesh Bank on September 5 last year to appoint receivers for all Beximco Group entities. However, upon appeal by Beximco Pharmaceuticals, the Appellate Division modified the order, allowing only Beximco Pharma to operate independently. Bangladesh Bank then appointed receivers for the remaining Beximco companies. Now, the High Court has ruled that all Beximco entities will function under their own management.

 

Barrister Muniruzzaman noted that the court validated all actions taken by the receivers during their tenure.

 

The initial writ petition was filed in August last year by senior Supreme Court lawyer Masud R. Sobhan, seeking control over Beximco’s enterprises. On September 5, the High Court ordered the appointment of receivers to manage all Beximco assets and instructed the attachment of the group’s properties for six months. The directive also sought to recover funds from Salman F. Rahman’s accounts across various banks and repatriate money from abroad.
