Chief Prosecutor Raises Questions Over Former PM’s Position in India

Bangladesh does not have clear information regarding the legal or official status under which former Prime Minister Sheikh Hasina is currently residing in India, according to International Crimes Tribunal Chief Prosecutor Mohammad Aminul Islam.
Speaking to reporters at the Supreme Court premises on Monday, Aminul said uncertainty remains over the exact basis of Hasina’s stay in India, making it difficult to assess reports suggesting that Indian court approval could be required before any possible transfer or return process.
Questions Over Legal Standing
The chief prosecutor noted that public reports have not clearly explained whether Hasina is in India under political asylum, a special visa arrangement, or another legal framework.
According to him, the absence of publicly available details has created uncertainty about what legal procedures may apply in any future proceedings involving her return to Bangladesh.
Extradition Request Already Submitted
Aminul stated that Bangladeshi authorities have already pursued legal channels and submitted a formal request to India seeking Hasina’s return.
He added that Bangladesh intends to continue addressing the matter through established legal mechanisms and diplomatic procedures.
No Comparison With Salahuddin Ahmed Case
Responding to questions about whether the situation resembles the case of BNP leader Salahuddin Ahmed, the chief prosecutor rejected comparisons between the two cases.
He noted that Ahmed’s circumstances involved separate legal proceedings in India after he was located in Meghalaya in 2015 and later cleared in the case brought against him there.
Growing Diplomatic Attention
The issue comes at a time when discussions between Dhaka and New Delhi remain under close scrutiny, with political, legal, and diplomatic questions continuing to shape relations between the neighboring countries.
Observers say clarification regarding Hasina’s legal status in India could become an important factor in future bilateral discussions between the two governments.
