Toby Cadman, Special Advisor to the Chief Prosecutor of the International Crimes Tribunal (ICT), has expressed hope that India, as a democratic nation, will respect Bangladesh’s judicial process and extradite Sheikh Hasina, the main accused in the July massacre case. Cadman made this statement following a meeting with the Chief Prosecutor and investigation officials of the ICT on Wednesday.

Cadman remarked that recent amendments to the ICT laws have aligned them with international standards, though further revisions might still be needed. He added that the tribunal would collectively propose additional recommendations for improvement.

Addressing the possibility of extradition, Cadman stated, “As a democratic nation, India is expected to respect the rule of law in Bangladesh. If an official request for Sheikh Hasina’s extradition is made, India should honor it.” He further noted that, should India refuse to comply, the Bangladesh government might proceed with an in-absentia trial under ICT laws. If necessary, the option to seek cooperation from the International Criminal Court (ICC) could also be explored.

When asked about the challenges of extradition to countries opposing capital punishment, Cadman emphasized, “Bangladesh’s situation is unique, and this needs to be understood by the international community. The decision on sentencing, including capital punishment, lies solely with the court.”

Earlier in the day, Cadman held discussions with ICT officials in Dhaka. His appointment as Special Advisor to the Chief Prosecutor was announced on November 21, with Cadman representing London-based law firm Guernica 37. Expressing his gratitude on social media, he wrote, “I am honored to have been appointed as Special Prosecutor Advisor to Bangladesh’s International Crimes Tribunal.”

Cadman has been actively involved in Bangladesh’s judicial processes since the fall of the Awami League government amid widespread student and public protests. He also met Chief Adviser Dr. Muhammad Yunus on September 2 at the latter’s residence, Jamuna.
